No.L-7/25(1)/2001-CERC - In exercise of the powers conferred by Section 28 of the Electricity Regulatory Commissions Act, 1998 Act and all other powers enabling in this behalf, the Central Electricity Regulatory Commission hereby makes the following regulations to amend the Central Electricity Regulatory Commission (Terms & Conditions of Tariff) regulations, 2001 namely :-
These regulations shall be called Central Electricity Regulatory Commission (Terms & Conditions of Tariff) (First Amendment) Regulations, 2001.
These regulations shall be deemed to have come into force w.e.f. 29th May, 2001 and shall remain in force upto 31-3-2004, unless reviewed earlier or extended by the Commission.
3. Insertion of proviso to clause(d) of Regulation 4.4
In Central Electricity Regulatory Commission (Terms & Conditions of Tariff) Regulations 2001, the following proviso shall be inserted at the end of the clause (d) of Regulation 4.4 in chapter 4, namely:-
Provided that in case of transmission projects executed through IPTC/JV routes, 1.5% (one and half percent) of the actual capital cost of the transmission project shall be allowed as O&M expenses during the first year of operation and these shall be escalated in subsequent years in accordance with the formula specified in clause (d) above.
4. Amendment of Regulation 4.10
In the Central Electricity Regulatory Commission (Terms & Conditions of Tariff) Regulations 2001 in Regulation 4.10 in Chapter 4 of the words "Transmission Utility" wherever occurring, the words "Powergrid Corporation of India Limited" shall be substituted.
5. Insertion of new Regulation 4.10A
In the Central Electricity Regulatory Commission (Terms & Conditions of Tariff) Regulations, 2001 after regulation 4.10 in Chapter 4, the following shall be inserted namely :-
4.10A Transmission Majoration Factor
Provided that Transmission Majoration Factor shall be allowed on HVDC projects executed through IPTC/JV routes.
Provided further that the Transmission Majoration Factor shall be allowed during the entire life of the transmission project to the new investor entering the transmission sector through IPTC/JV routes and who has been granted a transmission license under Section 27C of the Indian Electricity Act, 1910, upto 31-3-2004.
