The Commission has noted with serious concern the slow and tardy progress in the  implementation of the Commission’s order dated 30-10-1999  on IEGC.  The Commission has further noted with equal concern that its directive to insulate CTU function of the Powergrid Corporation of India Limited from its commercial functions  also has not been implemented and that the CTU has not submitted the draft procedure for regulation of power supply despite a clear directive to that effect.  Consequently, the Commission is constrained in the discharge of its functions of regulating the inter-state transmission of electricity. The Commission is of the opinion that the progress of implementation of its orders and directives issued from time to time,   would require greater degree of monitoring and guidance to CTU for the discharge of its statutory functions.

2.         The Commission, by virtue of its powers under Section 50 of the ERC Act, 1998, hereby orders to constitute a Bench of  the following members of the Commission and delegates its function of   monitoring the progress of implementation of the  orders of the Commission concerning IEGC and other directives of the Commission on the  Inter-State Transmission System issued from time to time:

(i)                 Shri D.P. Sinha, Member
(ii)                Shri G.S. Rajamani, Member
(iii)              Shri R.N.Srivastava, Member (EO)

3.         The above noted members of the Commission are delegated with authority to exercise all powers and functions of the Commission with further  authority to issue such directions as may be considered appropriate  to ensure speedy and proper compliance of the orders/directives of the Commission issued from time to time, and make further recommendations to the Commission regarding further course of action to be taken in the matter in case of non-compliance/non-implementation of the orders/ directives.

4.         The proceedings conducted by the Bench, shall be in conformity with the CERC (Conduct of Business) Regulations, 1999.  The Bench shall be competent to decide the place of hearing of the matters at CERC headquarters or at any other place and quorum for the meetings shall be two members.  The Bench  shall choose its own Chairperson.

5.         The Secretary of the Commission shall ensure that the Commission is apprised of the proceedings of the Bench at every meeting of the Commission or at an interval of three months, whichever is earlier.

6.         The aforesaid delegation of powers and functions to the Bench is without prejudice to the right of the Commission to take appropriate action in accordance with law, as the Commission may deem necessary in the facts and circumstances of the case.
